These Terms & Conditions apply to raising funds through the One Day Off website (http://onedayoff.org) and how Caring for Carers Australia makes arrangements for Carers to have One Day Off. These terms apply to Carers, Champions and the staff of Caring for Carers Australia who set up Carer Profile pages, as well as to donors. They also apply to content submitted for the One Day Off website (such as testimonials).
In these Terms & Conditions, the platform provided for the One Day Off campaign and ancillary services provided by Caring for Carers Australia is called the Services.
1 Acceptance of these Terms & Conditions
1.1 If you are under 18 years of age, you must obtain a parent or guardian’s consent before accessing or using the Website and the Services.
1.2 By creating a Carer’s Profile Page or donating to a Carer’s Profile Page, you accept these Terms & Conditions as updated from time to time. If you do not agree with these Terms & Conditions (including any amendments to these terms) you must not create a Carer Profile Page or donate through One Day Off.
1.3 We may update or amend these Terms & Conditions from time to time. You should check this page from time to time to make sure you are aware of any changes.
2 Overview: how we will raise the funds
2.1 One Day Off is a campaign run by Caring for Carers Australia which:
(i) allows Caring for Carers Australia to raise money for Carers; and
(ii) allows Caring for Carers Australia to use that money to fund 8 hours of respite, 8 hours of lawn/garden maintenance of 8 hours of cleaning while the Carer has One Day Off.
3 Eligible Carers
3.1 One Day Off allows Carers and Champions to create a Carer Profile Page through which people can make donations.
3.2 A Carer eligible for One Day Off is one of the following:
(i) an unpaid adult carer, either full time or part time, who provides care and support to family members and friends who have a disability, mental illness, chronic condition, terminal illness an alcohol or drug issue or is frail and aged;
(ii) an unpaid young carer, either full time or part time, who provides care and support to family members and friends who have a disability, mental illness, chronic condition, terminal illness an alcohol or drug issue or is frail and aged; or
(iii) a foster or kinship carer.
3.3 A person may only sign up to One Day Off as a Carer if they are an eligible Carer as described in paragraph 3.2.
3.4 Anyone can be a Champion. Champions must only sign up to One Day Off and create a Carer Profile Page for a Carer if that Carer is an eligible Carer as described in paragraph 3.2.
3.5 If Caring for Carers Australia reasonably suspects that a Carer Profile Page has been set up by or in relation to a Carer that is not an eligible Carer, it may it may close down the Carer Profile Page and where possible, funds will be returned to the donors.
4 Creating a Carer Profile Page
4.1 Carers can create a Profile Page for themselves. Champions can create a Profile Page for a Carer, however they must have the permission of the Carer to do so.
4.2 To create a Carer Profile Page, you will need to provide us with some personal information such as your name, mobile number and email address for the purposes of activating your account. You will also need to select a password. You can sign into your account using your email address and password. If you choose 8 hours of respite you will also need to provide some information about the support that the loved one requires so amount that needs to be raised can be determined. (see further section 6 below).
4.3 You must maintain the confidentiality of your password and you are responsible for all activities that are conducted through your account whether or not you have authorised such use.
4.4 Your account and your right to use the Services are personal to you and you must not authorise others to use your account. It is a condition of use of the Services that you ensure that your contact details are kept up-to-date and accurate. You can change or correct your information by logging-in to your profile.
4.5 You must contact us immediately if you believe someone has gained unauthorised access to your account.
5 Submitted content
5.1 Where you upload or provide information to us for inclusion on the One Day Off website, such as when creating a Carer Profile Page or submitting a testimonial, you warrant that you are the owner of the materials you upload (or that you are otherwise authorised by the owner to upload those materials).
5.2 You must not upload or otherwise transmit or distribute material which breaches any law, which infringes any third party rights (including obligations of confidentiality), which is inaccurate, misleading, defamatory, discriminatory, obscene, offensive, misleading, deceptive, inflammatory or which is threatening, abusive or invasive of another person’s privacy.
5.3 We may monitor and review any content you submit to a Carer Profile Page and we reserve the right to assess or examine the content when it is submitted. We may remove from your Carer Profile Page or elect to not publish content on your Carer Profile Page if, in our opinion, that content is or may potentially be:
(i) misleading, false or deceptive or otherwise contrary to law or regulation;
(ii) defamatory, discriminatory, abusive, threatening, offensive, obscene or racially vilifying;
(iii) inappropriate, off topic or vexatious;
(iv) spam, promotes a product or commercial service, or solicits business; or
(v) in breach of confidentiality, privacy or third party rights.
6 Setting the target amount
6.1 When you create a Carer Profile Page, you will be presented with 3 options (8 hours of respite, 8 hours of cleaning or 8 hours of lawn/garden maintenance). All three options have target amounts attached to them that Caring for Carers Australia will do its best to raise for you to have One Day Off. The 8 hours of respite targets are based on the amount of support required (e.g. whether you need a single support worker (1:1) worker or two support workers (2:1) to care for your loved one) and when it is required (i.e. weekday or Saturday). One Day Off on a Sunday is not offered. The cleaning and lawn/garden maintenance targets are set at $550 per Carer.
6.2 The target amounts are based on the information you provide us. We are not be responsible for any errors in the information you provide us.
6.3 The target amounts are based on 8 hours of a support worker, 8 hours of cleaning or 8 hours of lawn/garden maintenance (using the National Disability Insurance Scheme (NDIS) Price Guide hourly rates, as updated from time to time). When the NDIS rates change, the target amounts will be updated.
6.4 Caring for Carers Australia will raise the funds needed to pay for a support worker to look after your loved one, a qualified cleaner or lawn/garden specialist while you take a Day Off. The funds raised do not include any payment to the Carer.
6.5 The Website is set up to raise funds for care for one loved one, 8 hours of cleaning or 8 hours of lawn/garden maintenance. If a Carer has more than one loved one who needs care for the Carer to have One Day Off, please contact firstname.lastname@example.org so we can assist in setting the target amount for more than one loved one.
6.6 If the target amount for a particular Carer Profile Page is exceeded, the excess will be applied to another Carer Profile Page. The choice of the Carer Profile Page to which funds are applied is in the sole discretion of Caring for Carers Australia.
7 Time limit to raise the funds
7.1 For the Carer to have One Day Off between 1 April 2019 and 30 June 2019, the target amount must be met by 31st March 2019.
7.2 If the target amount is not met by 31st March 2019, then Caring for Carers Australia may, in its sole discretion, elect to top-up the funds so it meets the target.
7.3 If the target amount is not met by 31st March 2019 and is not topped-up, the funds will automatically carry forward to the 2019 campaign. The funds can only be carried forward to the next year’s campaign once.
7.4 If the target amount is not met during the next year’s campaign, Caring for Carers may use the funds raised in its sole discretion.
8.1 When you donate to Carer Profile Page, your donation will be used by Caring for Carers Australia in accordance with these Terms & Conditions.
8.2 When you donate to Caring for Carers generally (and not a specific Carer Profile Page), your donation will be used by Caring for Carers in the proportions described in clause 6.3, where the Support Component will be used to ‘top up’ a particular Carer Profile Page’s funds if it would otherwise fall a little short. The choice of the Carer Profile Page to which funds are applied is in the sole discretion of Caring for Carers.
9 How the One Day Off works
9.1 When the target is reached, Caring for Carers Australia will use the funds to either pay for a support worker to look after the Carer’s loved one for 8 hours, pay a qualified cleaner or lawn/garden specialist while the Carer has One Day Off. The support provided will be based on the same parameters as the funding target (e.g. 1:1 or 2:1 support and a weekday or Saturday).
9.2 Support will be provided by an independent service provider engaged by Caring for Carers Australia. Caring for Carers Australia will use best endeavours to match the Carer’s loved one with the service provider described in the registration process if this option has been chosen, however this may not always be possible.
9.3 The Carer must take their Day Off between 1 April 2019 and 30 June 2019 unless otherwise agreed by Caring for Carers Australia.
9.4 Caring for Carers Australia will use best endeavours to arrange for support to be provided on the Carer’s requested day off. However, as Caring for Carers Australia relies on the availability of its independent service provider, the Carer may need to be flexible to have a Day Off on the day that care can be arranged.
9.5 If Caring for Carers Australia is unable to arrange for support to be provided prior to 30 June on a day acceptable to the Carer, then another time mutually agreed by Caring for Carers and the Carer will be coordinated.
10 Making a donation
10.1 When you make a donation, you agree that Caring for Carers Australia will use it in accordance with these Terms & Conditions.
10.2 You agree not to use an invalid or unauthorised credit card. Once a donation is made, the transaction is final and not subject to dispute unless unauthorised use of your payment card is proved. If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card issuer in accordance with its reporting rules.
11 Intellectual property rights
11.2 You retain all intellectual property rights in all information you upload to a Carer Profile Page. You give us a worldwide, royalty-free, perpetual licence to use that information and such intellectual property rights for the purposes of providing the Services to you.
12 Privacy and personal information
12.2 Please ensure that you have permission before providing us the personal information other people, such as Champions providing information about Carers and Carers providing information about their loved ones.
12.3 When you provide us your information, you consent to us sending you information on other services available for Carers from time to time. If you wish to unsubscribe from such communications, please let us know by contacting us at email@example.com.
13 Your warranties and indemnities
13.1 You warrant that:
(i) you are at least 18 years old or have your parent’s or guardian’s consent to use the Services;
(ii) the information you have provided about yourself and others is accurate and you have the consent of those other persons to provide their information; and
(iii) you will use the website and the Services in compliance with applicable laws and these Terms & Conditions.
13.2 By submitting Submitted Content, you agree to indemnify us against all liability we may suffer or incur arising from any claims against us by third parties in connection with the content you submit being displayed on the One Day Off website (including a Carer Profile Page) including that any such content breaches privacy, intellectual property rights or any law.
14 Our disclaimer of warranties and liability
14.1 To the maximum extent permitted by law, Caring for Carers does not guarantee the quality or fitness for purpose of its services. Caring for Carers is provided on an “as is” and “as available” basis and you agree to use it at your sole risk. While we strive to make the services available to you at all times, we do not make any representations as to the availability of the services, or that your access or use of the website will be uninterrupted or timely. There may be delays, failures, errors, omissions or loss of transmitted information.
14.2 We do not give any warranty or guarantee about the information or materials on Carer Profile Pages.
14.3 To the extent permitted by law, under no circumstances will Caring for Carers Australia be liable to you for any loss or damages (direct or indirect) arising out of your use of the One Day Off website or any unavailability of the website or any portion of it.
14.4 Notwithstanding any other provision of these Terms and Conditions, Caring for Carers Australia disclaims all liability for consequential or indirect loss or damage suffered by you (including loss of opportunity, loss of data and loss in connection with third party claims).
15 Termination or suspension of a Carer Profile Page
15.1 We have the right to terminate or suspend access to or the operation of a Carer Profile Page (including in part) for any reason without notice and without liability. We may (without limitation) suspend access to a Carer Profile Page to conduct maintenance or implement updates.
16.1 If you have a complaint about One Day Off, you must first refer it to us so we can seek to resolve your concerns.
17.1 These Terms & Conditions are governed by the laws of Queensland. In the event that we have a legal dispute relating to One Day Off or these Terms & Conditions, you agree that Queensland courts will have jurisdiction.
